Terms of Service

1. License

NicheNeeds grants you a personal, non-exclusive, non-transferable, revocable license to play the Game for your own non-commercial enjoyment. All Game code, art, sound, characters, and other content remain the property of NicheNeeds.

2. Your account and nickname

The Game does not require an account. Your nickname is stored locally on your device. You are responsible for the nickname you choose. We may filter, replace, or refuse nicknames that contain hate speech, impersonation, harassment, or other content we judge to be inappropriate.

3. Acceptable use

You agree not to:

• Cheat, exploit bugs, or use automation that gives you an unfair advantage.
• Disrupt the Game for other players (lobby spam, deliberate disconnects, etc.).
• Reverse-engineer or attempt to access the Game's servers without permission.
• Use the Game to harass, threaten, or harm other players.
• Scrape, copy, or redistribute the Game's assets.

We may suspend or block players who break these rules.

4. User-generated content

If you submit feedback, bug reports, or suggestions, you grant NicheNeeds a perpetual, royalty-free license to use them to improve the Game. We are not obligated to credit you.

5. Availability

The Game is provided as is. We do not guarantee uptime, latency, or that any specific feature will continue to be available. We may add, change, or remove features at any time.

6. Disclaimer of warranties

To the maximum extent permitted by law, the Game is provided without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of liability

To the maximum extent permitted by law, NicheNeeds is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Game. Our total liability for any claim is limited to USD $50.

8. Indemnification

You agree to defend and indemnify NicheNeeds against any claim arising from your breach of these terms or your misuse of the Game.

9. Termination

You may stop playing at any time. We may terminate or suspend your access to the Game if you breach these terms.

10. Governing law

These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in New York County.

11. Changes

We may update these terms. Continued use of the Game after a change means you accept the new terms.
